The Law

The law - Receiving waste in port

According to act SJÖFS 2001: 13, recreational marinas are required to have devices for receiving waste from recreational boats.

The ports can cover their costs for the waste reception by charging a general fee, for example in the form of such as mooring fees, harbor dues and marina fee.  The ports are not allowed to charge special waste collection fees.

Anyone who charges a port fee or equivalent general fee is responsible for meeting the requirements regarding the reception of waste from recreational boats. A recreational marina that charges a mooring fee is therefore required to have the necessary reception facilities.

If no fee is charged, the property owner is responsible for ensuring that the requirements are met. The property owner who lends land to unpaid port operations has, of course, the possibility to ensure in the contract that the person using the land undertakes to fulfill the requirements for receiving waste.

Supervision marinas
In connection with the entry into force of the ban on the discharge of toilet waste from recreational boats in 2015, the Swedish Transport Agency will begin to work actively with the supervision of the recreational marina's waste reception.

It is clear that from April 2015 recreational boat owners will be able to report to the Swedish Transport Agency if they cannot leave their toilet waste to a recreational marina that normally receives boats with the need to leave toilet waste.

When the ban on the discharge of toilet waste from recreational boats comes into effect, the need for reception facilities in the recreational marinas that normally receive boats with toilet on board will also increase. In order to create good conditions for recreational boat owners to be able to follow the ban, the Swedish Transport Agency has started a project to develop a system for supervision of recreational marinas. The purpose is that it should be easy for recreational boaters to do the right thing. The idea is that the Swedish Transport Agency should start working actively with the supervision in connection with the emission ban.
